Terms and Conditions
Please read these terms and conditions carefully before using this Web Site.
These terms and conditions apply to all users of the Massage Therapy by Zada website (hereinafter referred to as “Web Site,”), the home page for which can be accessed at massagetherapybyzada.com (hereinafter “MTBZ”). Your use of this Web Site confirms your unconditional acceptance of the following Terms and Conditions. If you do not agree with the Terms and Conditions of this Web Site, please do not order from us.
1. Payment. All orders will be charged to the credit card you supply. It is the sole obligation of the MTBZ client to provide valid and correct credit card information to pay for any and all orders placed. If your credit card is declined, a $10.00 service fee will be added to your bill. MTBZ will attempt to charge any and all outstanding monies on a daily basis until all such monies are paid in full. MTBZ assumes no responsibility for NSF or bank fees associated with our attempts to collect money owed. We do not at any time allow clients to defer payment. A confirmation of your order will be sent via email and serve as your receipt. No additional statements will be sent out.
2. Shipping Limitations. When an order is placed, it will be shipped to an address designated by the purchaser. MTBZ’s business practice is to process and ship all orders within three - four business days through a third party drop shipment. MTBZ will make every reasonable effort to ship each and every order within the shipping deadlines and to secure complete customer satisfaction. (Business hours do not include weekends and or holidays).
3. Refunds. MTBZ agrees to replace or refund the purchase price of any item with which a customer is not satisfied or which is determined to be damaged or defective. Replacements or refunds are only available for products which are returned to MTBZ with a copy of the original invoice and a note from the customer explaining the basis of dissatisfaction and/or particular damage or defect within ten (10) days from the original sale. Refunds or replacements are only offered if the original product can be retrieved for inspection.
4. Products and Specifications. All features, content, specifications, products and prices of products and services described or depicted on this Web site, are subject to change at any time without notice. Certain weights, measures and similar descriptions are stated to the best of our knowledge and are provided for convenience purposes only. MTBZ makes all reasonable efforts to accurately display the attributes of its products, including the applicable colors; however, the actual color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors. The inclusion of any products or services on this Web Site at a particular time does not imply or warrant that these products or services will be available at any time. All bath products, lotions, creams, CDs and similar products sold are for private, home use (where no admission fee is charged) and/or non-public performance and may not be duplicated.
5. NO WARRANTY ON PRODUCTS. MTBZ endeavors to sell only the highest quality products, however, MTBZ is not a manufacturer of said products. MTBZ does not warrant the products sold herein, and by offering these products for sale, MTBZ is not making any representation or warranty regarding their safety or fitness for use for any ordinary, or extraordinary, use for which they may be applied.
6. Indemnification. You agree to indemnify, hold harmless and defend MTBZ or its employees, affiliates, subsidiaries and agents from any claims and expenses including attorney fees and damages, actions or negligence arising in connection with the violation of this agreement by you or through the use of this site or products. You further agree to indemnify defend and hold harmless MTBZ, its affiliates and any and all entities and persons associated in any way with MTBZ from any injury or liability or damages whatsoever arising from proper or improper use of products or from any damages injury or death resulting from use or misuse of the products in any way whatsoever.
7. Disclosure of Personal Information. The information we collect from you may be used to provide services and other information to complete your order. We will not sell or rent your personally identifiable information to anyone unless we have your consent to do so.
8. Third Party Links. Periodically, links may be established from this Web site to one or more external Web sites or resources operated by third parties (the "Third Party Sites"). These links are provided for your convenience only. In addition, certain Third Party Sites also may, with our written permission, provide links to the massage Therapy by Zada Web Site.
